Chapter 7 Bankruptcy Counsel

In a Chapter 7 bankruptcy, you can completely discharge certain debts in exchange for the sale or liquidation of your non-exempt assets. The new bankruptcy laws have made it more difficult for some debtors to file for protection under Chapter 7, requiring you to submit to a means tests to determine eligibility.

If you do qualify for protection under Chapter 7, I will make certain you know before you file which debts, such as student loans, child support arrearages and some taxes, cannot be discharged. I will also identify any property, including your principal residence and vehicle, that may be exempt from sale in a Chapter 7.

Chapter 13 Bankruptcy Representation

In a Chapter 13 bankruptcy, also known as reorganization, you agree to restructure your debts and pay a portion of your creditors over a 3 to 5 year period. I will work with the bankruptcy trustee to develop a payment plan. If you fail to meet your obligations in a Chapter 13 bankruptcy proceeding, you can lose the protection of the bankruptcy laws.
